Please read these terms of use carefully before using the Aesthetidocs website, mobile app, or online appointment booking platform (the site) – your use of the site is subject to these terms.
The site is operated by Aesthetidocs Limited (Aesthetidocs, we, our or us) of Lockview House, 49 Lockview Road, Belfast, Northern Ireland, BT9 5FJ.
By using our site, you confirm that you accept these terms and that you agree to comply with them. If you do not agree to them, you must not use our site.
Our site is a service operated by us to facilitate the arranging and managing of bookings with aesthetic treatment clinics. These terms only apply to the booking management process. You may be subject to additional terms and conditions with your treating clinic or practitioner which govern your relationship with them and any services they provide to you.
When you use our site, you will be providing us with personal data about you. You can see how we use personal data by going to our privacy policy www.aesthetidocs.com/privacy
Authorization to use the site
Subject to your compliance with these terms, you may access or use the site solely for the purpose of arranging, managing, and paying for bookings with clinics or practitioners offering aesthetic treatment services.
You must not access or use the site except as permitted by these terms. In particular, you must not and must not permit any other person to:
- Pretend that you are, or that you represent, someone else, or impersonate any other individual or entity when using the site.
- Resell, assign, transfer, distribute or provide others with access to the site or any of our materials.
- Copy, modify, frame, repost, publicly perform or display, sell, reproduce, distribute, or create derivative works of the site.
- Use the site to transmit, publish or communicate material that is defamatory, offensive, abusive, indecent, menacing or unwanted.
- Use the site in any way that damages, interferes with or interrupts the availability of the site.
- Introduce malicious programs into our hardware and software or our hardware, software and services which are integrated and operate together, including our networks, including viruses, worms, trojan horses and e-mail bombs.
- Reveal your account password to others or allow others to use your account.
- Use the site to carry out security breaches or disruptions of a network. Security breaches include accessing data where you are not the intended recipient or logging into a server or account that you are not expressly authorised to access or corrupting any data (including network sniffing/monitoring, pinged floods, packet spoofing, denial of service and forged routing information for malicious purposes).
- Use any program/script/command, or send messages of any kind, with the intent to interfere with, or disable, any person’s use of the site.
- Send any unsolicited messages through or to users of the site or to send any form of harassment via email, or any other form of messaging, whether through language, frequency, or size of messages or use the site in breach of any person’s privacy (such as by way of identity theft or “phishing”).
Any non-compliance by you with these terms shall give us the right to suspend provision of the site to you and access to your account, and to terminate our relationship with you without liability.
Reservation of rights
Aesthetidocs and its licensors each own and retain their respective rights in and to all logos, company names, marks, trademarks, copyrights, trade secrets, know-how, patents and patent applications that are used or embodied in or otherwise related to the site. Aesthetidocs grants no rights or licenses (implied, by estoppel, or otherwise) whatsoever to you under these terms.
Information provided to us
You are solely responsible for all data, information and other content, that you upload, post, or otherwise provide or store in connection with or relating to the site.
By providing us any information through the site, you grant Aesthetidocs a worldwide, non- exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable and transferable license to use, modify, reproduce, distribute, display, publish and perform that information in connection with the site. Aesthetidocs may remove or disable any information provided by you at any time for any reason, or for no reason at all.
You agree that we may share any information provided by you with the treating clinic or practitioner with whom you are seeking to make or have made an appointment.
Your commitments
You represent and warrant to Aesthetidocs that your activity on the site does not and will not violate, infringe, or misappropriate any third party’s copyright, trademark, right of privacy or publicity, or other personal or proprietary right.
You represent and warrant that all information you provide to us through the site is complete, accurate and not misleading. You must ensure that you promptly provide us with any updates or changes to any information previously provided to us.
Disclaimer
THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITH ALL ERRORS AND DEFECTS AND WITHOUT ANY WARRANTIES OF ANY KIND, AND AESTHETIDOCS EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND ANY REPRESENTATIONS OR WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. YOU ACKNOWLEDGE THAT AESTHETIDOCS DOES NOT WARRANT THAT YOUR ACCESS OR USE OR BOTH OF THE SITE AND ITS CONTENT WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR VIRUS-FREE, AND AESTHETIDOCS DOES NOT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE AND ITS CONTENT. NO INFORMATION, ADVICE OR SERVICES OBTAINED BY YOU FROM AESTHETIDOCS OR THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE T&Cs AND YOU SHOULD NOT RELY ON THE SITE AND THE GENERAL CONTENT ALONE AS THE BASIS FOR ANY DECISIONS.
NOTHING ON THIS SITE CONSTITUTES MEDICAL ADVICE, AND YOU SHOULD ALWAYS SEEK ADVICE FROM A QUALIFIED MEDICAL PRACTITIONER AS APPROPRIATE.
Liability
AESTHETIDOCS WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS OR THE LIKE) ARISING OUT OF OR RELATING TO THIS SITE, INCLUDING WITHOUT LIMITATION, YOUR USE OR INABILITY TO USE THE SITE, SITE, MATCHING SERVICES, CONTENT, PROPRIETARY INFORMATION, OR ANY INTERRUPTION OR DISRUPTION OF SUCH USE, EVEN IF AESTHETIDOCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE). THE AGGREGATE LIABILITY OF AESTHETIDOCS WITH REGARD TO THESE TERMS WILL IN NO EVENT EXCEED £50.
Updates to the terms
Aesthetidocs reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the site, or any portion of the site, for any reason; (2) to modify or change the site, or any portion of the site, for any reason; and (3) to interrupt the operation of the site, or any portion of the site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Aesthetidocs reserves the right, at its sole discretion, to change or modify portions of these terms at any time. Your continued use of the site after the date any such changes become effective constitutes your acceptance of the new or revised terms.
Jurisdiction
These terms shall be governed by and interpreted according to the law of Northern Ireland and all disputes arising under these terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Northern Irish courts.
Set out below are the terms and conditions, please ensure that you have read and fully understood them prior to booking any treatments or procedures at Natasha Boreland Aesthetics.
1. GENERAL TERMS AND CONDITIONS FOR ALL CLIENTS:
1.1. These terms and conditions form the basis of the agreement between the client (you) and Natasha Boreland Aesthetics (me).
1.2. Please read these terms and privacy policy carefully and take the opportunity to ask any questions.
1.3. By registering with me, you agree to be bound by these terms.
2. APPOINTMENTS, DEPOSITS AND CANCELLATIONS:
2.1. When you book an appointment, you will be required to pay a deposit, some or all of which I will be entitled to keep as set out in 2.2
2.2. If you later cancel the appointment without giving me prior notice of at least 24 hours or are a 'no show' for your appointment then your deposit is non refundable
2.3. If you know you are going to be late for an appointment, you should contact me to tell me. If you arrive later than 15 minutes after an appointment time, i will try to provide the service (consultation and /or treatment) you have booked, but if I decide that I cannot, the appointment will be treated as cancelled without notice by you and deposit will be kept as a charge for that appointment.
2.4. You may reschedule an appointment without charge if you give me at least 48 hours prior notice of the reschedule
2.5. If you cancel an appointment with at least 48 hours notice you will receive a full refund of your deposit.
2.6. If due to exceptional circumstances not limited to, illness, accidents and bereavement, you reschedule an appointment without giving me at least 48 hours prior notice, I will consider the circumstances and at my discretion decide whether to waive any charge for late cancellation.
2.7. I may cancel an appointment booked by you at any time before the time and date of that appointment in the following circumstances:
2.7.1. The required practitioner and/or materials necessary for the provision of the consultation or treatment are not available; or
2.7.2. There is an event outside of my control; If I reschedule an appointment in such circumstances, I will refund you in full any deposit or other advance payment you have made to me for that appointment.
2.7.3. I will use all reasonable endeavours to start the consultation or treatment at the appointment time you have booked, but the start may be delayed by the overrun of a previous appointment or by other circumstances. i will take the amount of time necessary to provide comprehensive care and attention to every single client and sometimes in complex or complicated cases this can result in clinic delays. If a delay to the start is at least 30 minutes, or, if at any time before or after you arrive for an appointment, I notify you that there will be a delay of at least that time, you may reschedule the appointment.
3. FEES AND PAYMENT:
3.1. You must pay in accordance with my price list for all services on completion of those that I have provided to you;
3.2. You may pay for services (and for any deposit or other advance payment on account of that payment) using any of the following methods:
3.2.1. credit / debit card,
3.2.2. cash;
3.2.3. gift voucher; or
3.2.4. bank transfer.
3.2 5. PayPal
3.3. I may alter my prices without prior notice, but if the price of any services increases between the time you book an appointment and the date of the appointment, the price increase for those services will not apply to your appointment.
3.4. Please note I will never hold credit card information on file and will never ask you to reveal details to me.
4. GIFT VOUCHERS:
4.1. Gift vouchers are available from the clinic
4.2. Gift vouchers are valid for the time period specified on the gift voucher (vouchers are valid for 12months from date of purchase)
4.3. Gift vouchers may be redeemed only for treatments which I provide at the clinic and may not be redeemed partly or wholly for cash.
4.4. Gift vouchers can only be used by the recipient or purchaser of the voucher.
5. ELIGIBILITY FOR TREATMENT:
5.1. I will not provide treatment to you if following your consultation, I believe that the treatment is not suitable for you or is not likely to be successful, as individuals differ in their responses to, and the outcome of, the treatment.
5.2. I will not provide treatments to you if you are under the age of 18. I may require evidence of your age for that purpose;
5.3. i will not provide treatments to you if you are pregnant, think you may be pregnant or are currently breast feeding; I will not provide certain treatments to you if you have a medical condition or are taking medication that may make that treatment unsuitable for you;
5.4. I will not undertake any treatment or procedure that is in conflict with any law in force, any voluntary or mandatory code of practice, or any similar rules, regulations or codes.
6. TREATMENT COURSE DISCOUNTS:
6.1. All treatments purchased as a course of treatments must be paid in full in advance or at the time of your first treatment;
6.2 I do not offer a refund or transfer of payment in the event of short term/ temporary side effects such as reddening, bruising, swelling, mild burning, blistering or hypo/hyperpigmentation as well as very rare side effects such as scarring and permanent discoloration.
7. BOTULINUM TOXIN REVIEWS:
7.1. Routine review appointments are offered after treatment with Botulinum Toxin as a courtesy. At this review you may be offered a complimentary additional treatment or ‘top up’ if it is clinically required;
7.2. Complimentary ‘top-up’ treatments must be taken 2 -3 weeks after the initial treatment. If you are unable to attend the review appointment within this time period, no additional complimentary treatment or ‘top-up’ will be provided.
8. DERMAL FILLER TOP UPS:
8.1. Dermal filler top ups are chargeable.
9. APPOINTMENT RULES:
9.1. Due to the clinical nature, it is required that you attend appointments alone. Failure to do so will result in the consultation/treatment being cancelled and loss of consultation fees and/or deposit.
9.2. I respectfully ask that when attending the clinic all mobile phones are switched off or silenced.
10. REFUNDS:
10.1. Every effort will be made to ensure you have the best possible outcome but as with all medical procedures there can be a spectrum of results. . As individuals differ in their responses to and the outcome of, the treatment, no clinical or financial guarantees can be given.
10.2. Treatment fees cannot be refunded in the case of a sub-optimal result (including no result), or complications, as all fees paid are related entirely to the services provided i.e. professional time, expertise, product costs and other costs incurred in providing the treatment, and those costs are incurred irrespectively of the results achieved. Additional costs may occur should complications arise from the treatment and further treatment is required.
11.RISK OF CLINICAL COMPLICATIONS:
11.1. The health and safety of my patients is at the heart of all I do and while I will do my very best to ensure a satisfactory outcome, no clinical procedure is entirely risk-free and the results of any particular procedure cannot be guaranteed;
11.2. Although rare, some procedures have well documented complications and these together with your personal risk will be discussed during your consultation and documented in the patient information leaflet and consent form;
11.3. Many complications can be managed simply and conservatively and I will, of course, treat these to the best of my ability and knowledge. However, in the unlikely event of a complication being more serious and you needing further treatment outside of my expertise, arrangements will be made for you to be treated in the NHS, or if you wish, privately at your own cost. Please be advised that private medical insurance may not cover complications arising from aesthetic treatments.
12. EQUIPMENT SAFETY:
Your safety comes first. If at any time I discover, or have concerns, that any of my equipment or machines are not in proper, working condition, I will ask you to reschedule your appointment and thank you for your understanding.
13. DOCUMENTS AND RECORDS:
13.1. All patients must complete a registration form and provide contact details including full name, date of birth, address, telephone numbers and email address;
13..2. All patients must complete a medical questionnaire at their first appointment, which is required for the consultation and treatment planning;
13.3. All patients will be asked to review and /or update their medical questionnaire at each appointment and will be asked to sign to confirm that their details remain accurate;
13.4. All patients will be asked to sign a consent form prior to any treatment. You have the right to change your mind to treatment at any time, even after you have signed the consent form;
13.5. I will keep records and case documents for each patient registered with me;
13.6. You have the right to request a copy of any documents which I may hold in relation to your care; and which I shall provide if you first pay a reasonable fee as determined by me;
14. MENTAL HEALTH DISORDERS AND AESTHETICS:
14.1. It is important that all patients considering aesthetic treatments have realistic expectations that focus on improvement rather than perfection. Complications or less that satisfactory results are sometimes unavoidable, may require additional treatment and can be stressful.
14.2. All clients must openly discuss with their practitioner, prior to treatment, any history they may have, of significant emotional depression, anxiety or mental health disorders.
14.3. Although many individuals many benefit psychologically from the results of aesthetic treatments, effects on mental health cannot be accurately predicted.
15. HOW I USE YOUR PERSONAL INFORMATION (DATA PROTECTION):
15.1. All personal information that I may use will be collected, processed, and held in accordance with the General Data Protection Regulation (“GDPR”) / The Data Protection Act 2018 and your rights under the GDPR; For complete details of my collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of your rights and how to exercise them, and personal data sharing (where applicable), please refer to my privacy notice.
16. LIMITATION OF LIABILITY:
16.1. It is the patient’s responsibility to ensure that he or she provide Natasha Boreland Aesthetics with all the relevant medical details prior to each treatment. Natasha Boreland Aesthetics will not be liable for any damage that occurs as a result of the patient’s failure to disclose such details;
16.3. The patient agrees to comply with all instructions and/or recommendations given to them, or on behalf of Natasha Boreland Aesthetics regarding their aftercare. Nothing in these Terms and Conditions shall exclude or limit’s Natasha Boreland Aesthetics liability for death or personal injury as a result of my breach of these Terms and Conditions or as a result of my negligence.
17. FEEDBACK:
All feedback is appreciated, both positive and negative. Feedback is used to review and improve the quality of my service. You may submit your feedback verbally, in writing, via email or on social media
18. COMPLAINTS:
I always welcome feedback from my patients and, whilst I always use all reasonable endeavours to ensure that your experience as a client of mine is a positive one, I nevertheless want to hear from you if you have any cause for complaint. If you have a complaint about my services or any other complaint about the clinic, please raise the matter with me.
19. CHANGES TO TERMS AND CONDITIONS:
I may from time to time change these Terms and Conditions without notice, but an up to date version will always be available.
20. ENTIRE AGREEMENT:
20.1 These Terms and Conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
20.2 Each party acknowledges that in entering into these Terms and Conditions it does not rely on and shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in the Terms and Conditions. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the Terms and Conditions.
21. SOCIAL MEDIA CONSENT (TO INCLUDE, PRINT, PAPER, DIGITAL, VIDEO AND SOCIAL MEDIA):
21.1. Upon you the client signing consent for his or her image to be used for promotional and social media use, you grant Natasha Boreland Aesthetics and it’s designees the right in perpetuity to use your name, likeness, image, voice, appearance, and performance as embodied in the product whether recorded on or transferred to video files, photographs, audio tapes, or other media, now known or later developed.
